REFUND POLICY 

Unfortunately we are a no-refund event.  Costs to produce the races are typically spent weeks and even months prior to the event. 

Thank you for understanding. 

 

 DEFERRAL/TRANSFER OPTIONS 

 

If you cannot participate in an event you are registered for, for any reason, you may defer to a future event in the same calendar year for a small transfer fee.  There are no transfers within 14 days of the current event you are registered for. 

If you defer to a future event the following year, the following conditions apply:

 

  • 100% credit if you request a deferral 30 days (or more) prior to the current event*
  • 70% credit if you request a deferral 15-29 days prior to the current event*
  • NO deferrals or transfers within 14 days of the current event. 

 

*credits are for registration fees only, and do not include processing fees, taxes, or other applicable fees.

 

IMPORTANT REMINDER:  You must provide 14 days notice before the original event to defer or transfer your entry.

Waiver & Release Form

 

Please read any waiver carefully. It includes a release of liability and waiver of legal rights and deprives you of the ability to sue certain parties. Do not agree to this document unless you have read and understood it in its entirety. By agreeing electronically, you acknowledge that you have both read and understood the text presented to you as part of the registration process.  You also understand and agree that events carry certain inherent dangers and risks, which may or may not be readily foreseeable, including without limitation personal injury, property damage or death.  Your ability to participate in the event(s) is/are subject to your agreement to the waiver and by agreeing herein, you accept and agree to the terms of the waiver and release agreement. By indicating your acceptance, you understand, agree, warrant, and covenant as follows:

 

ALL PARTICIPANTS IN THE EVENT AND RELATED EVENTS ARE REQUIRED TO ASSUME ALL RISK OF PARTICIPATION BY AGREEING TO THIS RELEASE AT TIME OF ONLINE REGISTRATION OR BY SIGNING THIS RELEASE AND WAIVER OF LIABILITY AGREEMENT

The undersigned athlete (“Athlete”) on behalf of himself/herself and on behalf of the Athlete’s personal representatives, assigns, heirs, executors, hereby fully and forever releases, waives, discharges and covenants not to sue Skol Sporting Management, Skol Events, the race organizer, management company, individual, and/or municipality associated directly or indirectly with this event, including all municipal agencies whose property and/or personnel are used and all other sponsoring or co-sponsoring companies or individuals related to the event (collectively, “Releasees”) from all liability to the Athlete and his/her personal representatives, assigns, heirs, and executors, for all loss(es) or damage(s) and any and all claims or demands therefore, on account of injury to the Athlete or property or resulting in the death of an Athlete, whether caused by the active or passive negligence of all or any of the Releasees or otherwise, in connection with the Athlete’s participation in the event.  The Athlete represents and warrants that he/she is in good physical condition and is able to safely participate in the event.  The Athlete is fully aware of the risks and hazards inherent in participating in the event and hereby elects to voluntarily compete in the event, knowing the risks associated with the event, including, without limitation, weather conditions such as high heat and/or humidity, wind, hail, rain, snow, flood, traffic and the condition of the road, all such risks being known and appreciated by the Athlete.  The Athlete hereby assumes all risks of loss(es), damage(s), or injury(ies) that may be sustained by him/her while participating in the event.  The Athlete agrees to the use of his/her name and photograph in broadcasts, newspapers, brochures, and other media compensation.  The Athlete acknowledges that the entry fee is non-refundable and non-transferable.  In the event the event is delayed or prevented by reason of fire, threatened or actual strike, labor difficulty, work stoppage, pandemic, insurrection, war, public disaster, flood, unavoidable casualty, acts of God or the elements (including, without limitation, hurricanes, floods, tornadoes and earthquakes), or any other cause beyond the control of the race organizer and management, there shall be no refund of the entry fee or any other costs of the Athlete in connection with the event.  The Athlete understands that the Athlete may be receiving a rental chip at packet pickup and will be charged $50 if the Athlete does not return the rental chip.  The Athlete warrants that all statements made herein are true and correct and understands that Releasees have relied on them in allowing the Athlete to participate in the Marathon.

 

BY COMPLETING THE REGISTRATION PROCESS IN ANY FORM (ONLINE, IN-PERSON, MAIL, ETC), THE ATHLETE HAS READ THE FOREGOING AND INTENTIONALLY AND VOLUNTARILY AGREES TO THIS RELEASE AND WAIVER OF LIABILITY AGREEMENT.

 

I, (name of participant or parent/guardian if participant is under 18 years of age), do hereby for myself and my heirs release and discharge Red Mountain Running LLC., Skol Sporting Management, LLC, Hurricane City, and any other volunteers or assistance from all claims, demands, and causes of action of every kind whatsoever for any damages and/or injuries which may result from my participation in the race. I know that running in a road race is a potentially hazardous activity. I should not enter and run unless I am medically able and properly trained. I assume all risks associated with running or participating in this event including, but not limited to: falls, contact with other participants, the effects of weather, including high heat and/or humidity, traffic and the conditions of the road or trail, all such risks being known and appreciated by me. Having read this waiver and knowing these facts and in consideration of your accepting my entry to participate in this race, I, intending to be legally bound, do hereby for myself, my heirs, my executors, and administrators agree as follows:

1. I do waive and forever release any and all rights and claims for any damages and liabilities of any kind arising out of my participation in the Event against all persons, entities, and agencies involved with promoting the Event, their agents, successors, representatives, and assigns even though that liability may arise out of negligence or carelessness on the part of the persons named in this waiver.

2. Further, I assume the risk of all bodily injuries, including death, resulting therefrom, and personal injuries to me and damage to and loss of my property, including loss of use thereof and any other indirect or consequential damages, resulting directly or indirectly, wholly or in part, from my participation in the Event and while traveling to and from the Event;

3. Further, I hereby agree to inidemnify, defend, and hold all entities involved in the event harmless from and against any and all claims, liabilities, losses, damages, costs, expenses (including attorney's fees), judgements and penalties arising out of any of my acts or omissions to act;

4. Further, in the event that the participant is a person under 18 years of age, the undersigned parent or legal guardian of the participant agrees to indemnify, defend, and hold harmless the entities named in paragraph numbered 1 above from and against all claims, liabilities, losses, damages, costs, expenses (including attorney's fees), judgements, and penalties arising out of the participant's participation in the Event.

WAIVER: I, the undersigned participant (and my parent or guardian if I am younger than 18 years of age), intending to be legally bound, do hereby forever release and waive any and all rights, claims, and actions for damages that we, our heirs, executors, administrators, and assigns may have, or that may hereafter accrue against any and all persons, organizations, and other entities associated with the event, including, but not limited to Race Entry, Skol Events, sponsors, affiliates, volunteers, Baker's Dozen Half Marathon, Relay, and individual Baker's Dozen Half Marathon, Relay organizers, arising out of or in connection with my involvement before, during, or after the event.

I verify that I am physically fit and sufficiently trained to participate in this event and I assume the risks involved in this activity. I further attest that I will be mindful of traffic along the race course, and hold said sponsors and organizers blameless in any harm that may happen.

I consent to the collection and use of my Personal Information as contained in the Privacy Policy. I also give my permission for the free use of my name and/or pictures in telecasts, broadcasts, newspapers, posters, advertising, etc.

I also acknowledge understanding that the charge to my card will show up as Race Entry. I acknowledge that the online processing fees and charitable donations are non-refundable. I also acknowledge that any charitable donations will have 4.97% withheld from the donation to pay credit card and administrative costs.

Race Entry and its partner Skol Events shall not be liable to you for any direct, indirect, special, incidental, consequential or exemplary damages including, but not limited to, loss of profits, goodwill, use, data or other intangible loses. Race Entry and its partner Skol Events does not guarantee the completeness or accuracy of any information contained in, or provided in conjunction with the http://www.raceentry.com website. Race Entry and its partner Skol Events is not responsible for any omissions or inaccuracies, or for the results obtained from this information.

Race Entry and its partner Skol Events facilitates registration for various events, some of which allow participants under the age of thirteen (13). We require a submission of birth date for all registration entries. For children under the age of thirteen (13), parental or guardian consent is required.

You agree that the statutes and laws of the State of Utah, USA, will apply to all matters relating to this Agreement and Waiver. You irrevocably consent that exclusive jurisdiction for any dispute with Race Entry and its partner Skol Events relating to this Agreement and Waiver resides in the courts of Utah, and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of Utah in conjunction with any such dispute including any claim involving Race Entry and its partner Skol Events.
